If you have a job…. expect to see a big deduction soon. When they find your employer they will present them with a garnishment order and that means that up to 25% of your income goes straight to them and will be deducted from your pay check by your employer BEFORE you get the rest.

If you don't have a job… they will search for your bank and once they find account(s) that have your name on it (that includes joint accounts with spouses, parents or children, etc.) they will empty these accounts irregardless of any checks that you wrote on the account or the fact that you need this money to survive.

I finally managed to get through by phone yesterday afternoon to the county civil courts to ask about my case. The clerk told me that the case was pending the magistrate's review and that would occur April 5th. I didn't need to be present for the review, that was just the date it was scheduled to happen and that a trial date would be set from there (if that's what the judge decided to do).

She didn't know anything about the plaintiff's motion for pre-trial conference and tried to forward me to the magistrate's clerks, but all I got there were answering machines.

So, for now, I'm just going to wait it out and see how the judge decides on the case and for more paperwork from the courthouse (and I'll keep my eye on the docket to make sure I'm not scheduled to appear and no one told me).

Should I be preparing discovery requests to give to the plaintiff? What should I ask for? Are there a set of admissions I could write to send to them that if ignored I could get them admitted as facts? I did go back and check my credit report and it appears the original account with the OC was closed 1/2005 and the collection agency now suing for it obtained the account 2/2007. But as I recall, the SOL is on the original debt and not when the JDB picked it up, right? In addition to being prepared to defend it on SOL grounds should I also be preparing to show that the plaintiff has no right to collect the debt in the first place?

Reply:ahh the pre-trial conference stage. there will be a bunch of these. I know some lawyers use the tactic of trying to get as many PC's as they can to make the defendant miss as much work as possible so they end up having to settle the case because they are losing so much $$ in wages.

in different jurisdictions these have different names, pre-trial conference, settlement conferences, case management conferences. but they are all basically the same. the court wants you to come together before trial to try and work out your issues and settle, courts do not want a bunch of trials on their docket.
