Reply:Charge cards like Radio Shack and Sears are sales of goods which is a 4 year SOLC in Georgia.

When the predominant element of a contract is the sale of goods, the contract is viewed as a sales contract and 11-2-725 is the applicable statute of limitations even though a substantial amount of service is to be rendered in installing the goods. When the predominant element of a contract is the furnishing of services, this section (9-3-24, 6 year SOLC for written contracts -ihc) applies.

There is nothing clearcut for SOLC on credit cards in Georgia, and it appears similar to Florida… You'd argue that to prove a credit card debt, they'd need parol evidence which would fall under the 4 year SOLC.

Reply:I would say 6 years, as a written agreement or contract.
