So what if I just pay them off? [recollection] [creditor]

I have a CA to me for a 7-year-old debt – that I have no recollection. I have made some mistakes then, and spent 2 years laboriously fixing my credit card and billing of all my collection accounts.

rnSo, now this comes out of nowhere. I think it's wrong, but I did not keep great track of things back then. I know I never heard from the company that they claim the original was out creditor.

rnIch u0026 go forth with them – challenge the debt in the validation letter u0026 everything. I suspect it is a JDB trying to something that is past the statute of limitations to collect – or would it not my fault in the first place.

rnWer know how this affects me credit report? I am reluctant to pay because they end of May to stay on my report for years, while I may be able to delete it when I fight.

rn I had another collector contact me on a debt that I probably standing on the – so my guess is that they bind to collect the unpaid part. This is seven years old.

Yes, you can write a check to yourself and then use the funds to pay off the other Discover accounts. However, read all the fine print. You will have a cash advance/balance transfer fee of 3% to 5%, depending on your card terms. Unless you have some special low interest rate offer, the interest will be at the much higher cash rate and interest will begin to accrue immediately.

In other words, it just may not be such a good deal when you figure in the fee and higher interest rate.

Remember not to confuse the "DOLA", date of last activity with the "DOFD", date of first delinquency. You are only concerned about the date of first delinquency. 8-) It certainly appears that 7 yrs. is far past the last date you paid on this account which is the reason why we asked you to send the cease and desist letter due to the statue of limitations. I had an occasion where a collector tried to get a 25 yr. old debt from my elderly parents. He kept harassing them on the phone. One day I was there and talked to him and after talking to me, he not only never called again but the letters also stopped! :yahoo: He realized that he was talking to someone who was knowledgeable about the credit laws. :punknanner:

Reply:I'm with everyone else. Paying them would be the absolute worst thing you could do. If you pay them and they don't hold up to their end of the "bargain," whic inevitably they won't, they're collection agents after all, then you're screwed. It will sit on your credit for years to come. Use the resources here on this board to get rid of them once and for all.

Reply:I agree with the others. A Cease and Desist letter would be appropriate for a debt that is actually out of the statue of limitations, which I believe for your state (CA) is 4 yrs. 8-)

I concur, a C & D letter would stop it all.

But, if your greedy, and have too much time on your hands, you could fight them, record and CMRR everything and possibly rack up some violations so they can pay you for your time.
